Common Pitfalls of Investible Assets for Successor Trustees, presented by Jeremy Lau CFA®CFP® Many grantors are not aware of the obligation to comply with the Uniform Prudent Investor Act (UPIA) when successor trustees are named. The increased responsibility and liability for the successor trustee necessitates that they evaluate the trust for compliance with UPIA and if not compliant, to document the reasons for non-compliance (ie. Capital gains taxes are too great) or to adjust the invested trust assets to comply with the returns, risk, and diversification obligations of UPIA.
