Attorney’s Fee Awards to Trust Beneficiaries

Attorneys Denise E. Chambliss and Ariel G. Siner will discuss the grounds for a beneficiary to recover an award of attorney’s fees.  They will discuss the equitable grounds under the Substantial Benefit Doctrine and the Common Fund Doctrine.  They will also discuss the statutory grounds for fee awards, including Probate Code §17211 (bad faith oppositions to accountings and more), and Welfare and Institutions Code §15657.5 for financial elder abuse matters.  Their presentation is drawn from their article, Smith v. Szeyller: Probate Court Authority for Attorney’s Fee Award under the Substantial Benefit Doctrine for Successful Beneficiaries, California Trust and Estates Quarterly, Vol. 26, Issue 2, 2020.

Ms. Chambliss is a partner at Hoge Fenton in the Bay Area, where she is chair of the trusts and estates litigation group.  Ms. Siner is an associate in the trusts and estates litigation group at Hoge Fenton.
