Here are the details on the CLE:

Please join us for a presentation on the evolution of California’s conservatorship laws.  Fifteen years ago, the Legislature enacted the California Conservatorship Reform Act.  In 2021, the Legislature passed new reforms in AB 1194.  Then again, in 2022, the Legislature continued implementing additional reforms in AB 1663.  This program will examine several broad themes in the recent legislation: the enhanced autonomy of conservatees and focus on their preferences; the duties of the courts to investigate and suggest alternatives to proposed conservatees; the new legislative focus on modifying and terminating conservatorships; the role of court-appointed attorneys; and the new punitive disciplinary provisions and focus on restricting fees for conservators and their attorneys.

Our presenters are attorneys Mark Schmuck and Peter Stern.  Mr. Stern practices in Palo Alto, where he specializes in estate planning, conservatorship, special needs planning, and elder law.  Mr. Stern is a member of the American College of Trusts and Estate Counsel (ACTEC), and he is former chair of the Trusts and Estates Executive Committee (TEXCOM) of the California Lawyers Association.  He recently authorized the article, “AB 1194: Another Conservatorship Reform Act: Was It Really Necessary,” for the CEB Reporter.  Mr. Schmuck is the probate research attorney for the Contra Costa County Superior Court.  He recently authored the article, “LPS, General, and Limited Conservatorships: Where We Were, Where We Are and Where We Might be Going,” for the Trusts & Estates Quarterly.
